These Terms apply to the Wash Club membership program operated by Top Wash Orange. By joining the Wash Club, using your membership, or authorising payment, you agree to these Terms.
1.1 The Wash Club is a recurring membership program that gives members access to selected car wash services at the Top Wash Orange location.
1.2 Your plan confirmation will state your plan name, inclusions, price, billing cycle, nominated vehicle or vehicles, wash entitlement, and any special conditions. Any individually agreed or multi-vehicle arrangement must be confirmed by us in writing. If a specific written plan condition is inconsistent with these Terms, the specific plan condition applies to the extent of that inconsistency.
1.3 Membership benefits are not transferable unless we agree in writing.
1.4 These Terms apply in addition to any site rules, safety directions, signage, and staff instructions at our car wash locations.
2.1 Your membership includes the wash services listed for your selected plan.
2.2 Unless stated otherwise, prices are in Australian dollars and include GST.
2.3 Washes are subject to site availability, operating hours, safety requirements, equipment limits, weather conditions, maintenance and staff directions.
2.4 If your plan is described as “unlimited”, it permits a maximum of one included wash per calendar day under the membership while the membership is active and paid, unless your written plan confirmation expressly states a different wash entitlement.
2.5 A daily wash entitlement cannot be accumulated, banked, carried forward, transferred, exchanged for cash or used to wash a vehicle that is not nominated under the membership.
2.6 “Unlimited” does not permit:
a. more than one included wash per calendar day under the membership;
b. sharing, lending, selling or transferring membership access;
c. washing vehicles that are not nominated under the membership;
d. using multiple accounts, access fobs or membership identifiers to avoid a usage restriction;
e. reselling or providing washes to another person; or
f. commercial, fleet or business use unless expressly included in the selected plan.
2.7 If a plan includes more than one nominated vehicle, the written plan confirmation will state whether the wash entitlement applies separately to each vehicle or collectively across the membership. The addition of another vehicle does not create an additional daily wash entitlement unless that entitlement is expressly confirmed in writing.
2.8 Unused washes, unused days or unused membership benefits do not roll over to the next billing period.
2.9 Membership does not include detailing, hand washing, polishing, interior cleaning, pet hair removal, stain removal, odour treatment or other extras unless expressly included in your plan.
3.1 Each standard membership applies to one nominated vehicle only unless the written plan confirmation expressly identifies additional nominated vehicles.
3.2 Each nominated vehicle must be recorded against the membership using its registration number or another vehicle identifier accepted by us.
3.3 Multi-vehicle, promotional or individually agreed memberships are only valid when confirmed by Top Wash Orange in writing. The confirmation must identify the included vehicles, price, wash entitlement and any special conditions.
3.4 If we issue you with a Wash Club access fob, RFID tag, barcode, QR code or other membership identifier, it remains linked to your membership and nominated vehicle or vehicles.
3.5 You must not share, transfer, lend, copy or misuse your membership identifier. If it is lost, stolen, damaged or used without your permission, you must notify us as soon as reasonably possible. We may charge a reasonable replacement fee for a lost or damaged access fob.
3.6 You must keep your vehicle and contact details up to date.
3.7 You may request to replace a nominated vehicle by contacting us. We may require reasonable evidence that the replacement vehicle is owned, leased or regularly used by you. A membership cannot be repeatedly moved between vehicles for the purpose of sharing the membership.
3.8 Unless your plan expressly allows it, a membership must not be used for taxis, rideshare vehicles, delivery vehicles, fleet vehicles, commercial vehicles, rental vehicles, dealership vehicles or vehicles used primarily for business purposes.
4.1 By joining the Wash Club, you authorise us or our payment processor to charge your nominated payment method for the membership fee at the billing frequency shown at signup.
4.2 Membership fees are billed in advance.
4.3 Your first payment is charged when you join, unless a promotional offer states otherwise.
4.4 Your membership automatically renews each billing period until cancelled in accordance with these Terms.
4.5 You are responsible for ensuring your payment method remains valid and has sufficient funds.
4.6 If a payment fails, we may retry the payment, suspend your membership, cancel your membership, or recover reasonable third-party costs we incur because of the failed payment.
4.7 If your billing date falls on a day that does not exist in a particular month, or on a non-processing day for our payment provider, your payment may be processed on the nearest available processing day.
4.8 If you pay by bank-account direct debit, you may also have rights to cancel or stop a direct debit through your financial institution. Cancelling a payment authority does not necessarily cancel amounts already owed for services supplied.
5.1 You may cancel your membership at any time by emailing us at accounts@topwashorange.com.au / calling 0477 740 911 .
5.2 Cancellation takes effect at the end of your current paid billing period unless we agree otherwise or the law requires otherwise.
5.3 To avoid being charged for the next billing period, you must cancel before your next billing date. For bank-account direct debits, we recommend allowing at least 3 business days for processing.
5.4 We do not charge cancellation fees.
5.5 If you are charged after a valid cancellation request made before the required cut-off, contact us and we will review the charge. If the charge was made in error, we will refund it.
5.6 We may cancel your membership if you breach these Terms, misuse the membership, fail to pay fees, behave abusively or unsafely, damage equipment, or repeatedly fail to follow staff instructions.
6.1 We may change membership fees, plan names, benefits, inclusions, billing arrangements, or these Terms by giving you at least 30 days’ notice.
6.2 Any price increase or material reduction in benefits will not apply until your next billing period after the notice period ends.
6.3 If you do not agree to a change, you may cancel before the change applies.
7.1 We do not usually provide refunds for unused washes, unused days, failure to use your membership, or change of mind.
7.2 We do not usually provide refunds for temporary closures, weather interruptions, maintenance, equipment downtime, or safety-related interruptions.
7.3 However, nothing in these Terms limits your rights under the Australian Consumer Law.
7.4 If our services are unavailable for an extended period due to matters within our reasonable control, we may, where appropriate, offer a credit, extension, refund, or other remedy.
8.1 Promotional offers are subject to the specific terms displayed with the offer.
8.2 Unless stated otherwise, promotions are available to new members only, cannot be exchanged for cash, and cannot be combined with other offers.
8.3 If your membership starts with a discounted or trial period, the standard membership fee will apply after the promotional period ends unless you cancel before the next billing date.
9.1 Before entering the wash, you must:
a. remove or secure loose items;
b. close windows, doors, sunroofs, canopies, trays, and fuel caps;
c. fold in mirrors if instructed;
d. remove or secure aerials, racks, flags, magnetic signs, and non-standard accessories where possible;
e. ensure the vehicle is in the correct gear or mode as directed;
f. follow all signage, traffic lights, staff directions, and safety instructions.
9.2 You must tell staff before using the wash if your vehicle has:
a. existing damage;
b. loose panels, trims, mirrors, spoilers, number plates, wipers, or accessories;
c. aftermarket parts or modifications;
d. roof racks, ladder racks, bike racks, bull bars, light bars, canopies, awnings, antennas, or other protruding items;
e. low clearance, oversized tyres, lowered suspension, or unusual dimensions;
f. paint, wrap, ceramic coating, decals, or signage that may be unsuitable for automatic washing.
9.3 We may refuse to wash any vehicle we reasonably believe is unsafe, unsuitable for the wash equipment, excessively dirty, carrying hazardous materials, or likely to damage the wash equipment, staff, customers, or other vehicles.
10.1 We take reasonable care in providing our services.
10.2 You acknowledge that automatic car washing may not be suitable for all vehicles, especially vehicles with pre-existing damage, loose parts, aftermarket accessories, non-standard modifications, delicate finishes, or unsecured items.
10.3 We are not responsible for loss or damage to the extent the loss or damage is caused by:
a. pre-existing damage or defects;
b. loose, faulty, worn, non-standard, or insecure vehicle parts;
c. aftermarket accessories or modifications;
d. failure to follow site instructions;
e. items left in or on the vehicle;
f. your negligence, misuse, or unsafe conduct;
g. circumstances outside our reasonable control.
10.4 We may be responsible where loss or damage is caused by our failure to provide services with due care and skill, or where we are otherwise liable under law.
10.5 If you believe your vehicle has been damaged, you must notify staff before leaving the premises, or as soon as reasonably possible, and provide your membership details, vehicle details, photos, and any other information reasonably requested.
10.6 Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law.
11.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
11.2 For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value.
11.3 You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
11.4 If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
12.1 We may temporarily close a site or suspend services due to weather, maintenance, repairs, equipment issues, safety concerns, staffing, utilities, emergencies, or circumstances outside our reasonable control.
12.2 We will try to minimise disruption where reasonably practicable.
12.3 Temporary unavailability does not automatically entitle you to a refund, except where required by law.
13.1 You must behave safely and respectfully at all times.
13.2 We may refuse service, suspend access, or cancel your membership if you abuse staff, damage property, obstruct operations, breach safety rules, use the membership fraudulently, or engage in conduct we reasonably consider inappropriate or unsafe.
14.1 We collect personal information to operate the Wash Club, including your name, contact details, payment information, vehicle details, number plate, membership usage, wash history, and communications with us.
14.2 We use this information to manage your membership, process payments, identify your vehicle, provide wash services, improve our services, prevent misuse, communicate with you, and comply with legal obligations.
14.3 We may disclose information to payment processors, software providers, SMS/email providers, IT providers, professional advisers, insurers, and other service providers who help us operate the Wash Club.
14.4 If you use a number-plate recognition system, RFID tag, barcode, QR code, app, or similar technology, we may use it to verify membership access and record wash usage.
14.5 Payment details may be collected and processed by our payment processor. We do not store full card details unless expressly stated.
14.6 Our Privacy Policy explains how we handle personal information and is available at topwashorange.com.au/privacy-policy.
15.1 We may send you service-related communications about your membership, payments, changes to these Terms, site closures, safety issues, and other administrative matters.
15.2 We will only send promotional emails or SMS where we have the consent required by law.
15.3 You may unsubscribe from marketing communications at any time. Unsubscribing from marketing messages does not stop service-related membership communications.
16.1 We may update these Terms from time to time.
16.2 If a change materially affects your membership, we will give you reasonable notice before the change applies.
16.3 If you do not agree with the change, you may cancel your membership before the change applies.
17.1 If you have a complaint, contact us at info@topwashorange.com.au with your name, membership details, vehicle details, and a description of the issue.
17.2 We will review your complaint and respond within a reasonable time.
17.3 These Terms are governed by the laws of New South Wales, Australia.
